Making money from tourist photography in NYC

So here's my idea. I've been reading up on this a bit, but here it goes:

I'm moving to New York City soon, and something I'd like to do on the side once I find a job is to buy say, an instax camera with some film, and shoot pictures of people who come up to me (I'll hold a sign). They'd get the instant photos and I'd charge a few dollars a shot. I'm just wondering about the legality of it. I'm hearing that all I'd have to do is get a tax ID number so I could legally pay taxes on what I make, but the act of selling art on the street is covered by the first amendment. Just wondering if anyone here has had any experience doing something similar.

Mind you, I'm not a lawyer so take this with a HUGE grain of salt, but I cant imagine that this would be any worse than being a busker. You probably wouldn't make enough to get on the IRS radar.

I used to travel and take pictures but it never came up to my mind that I can earn money through these pictures. I have here my latest pictures from my trip to Malaysia. We stayed there at Penang hostel for 3 days and 3 nights and I have taken multiple pictures from that place.
